This CLE course will provide counsel to healthcare systems and providers with guidance on policies and procedures to address allegations of physician sexual misconduct. The panel will discuss investigations, reporting requirements, and the impact on privileges as well as examine recent cases.
Faculty

Mr. Souter is known for his legal and educational experience in the healthcare industry, making him a sought-after resource for clients and students alike. His primary areas of practice are related to transactional and administrative healthcare, corporate, securities and antitrust matters. Mr. Souter is also a Professor of Healthcare Studies at Baylor University School of Law where he oversees the healthcare law program and teaches Healthcare Law, Healthcare Fraud and Abuse and Regulation of Healthcare Professionals. He is also involved with the Robbins Institute for Health Policy and Leadership at the Baylor University Hankamer School of Business where he teaches Healthcare Law and Ethics in its M.B.A. in Healthcare Administration Program and Executive M.B.A. Program.

Mr. Zinsmaster provides trusted counsel and advocacy to healthcare clients on a variety of matters such as corporate compliance, provider credentialing, administrative proceedings, and litigation. He also advises clients on practice formation and acquisition, as well as contract review and preparation. In recent years, Mr. Zinsmaster has helped healthcare companies and providers navigate through fraud and abuse investigations, antitrust reviews, and other white collar criminal matters. Prior to joining the firm, Mr. Zinsmaster practiced for nearly seven years with the State Medical Board of Ohio, where he advised board members and agency personnel on issues related to licensure and professional ethics, as well as federal rules and regulations implicating the area of healthcare. His substantial regulatory experience enables him to bring a unique and insightful perspective to handling diverse and complex healthcare matters, and his thorough understanding of healthcare laws and policies helps him serve as a valuable resource to corporations, healthcare associations, hospitals, medical practices, and individual practitioners.
Description
With the increased attention on sexual misconduct, healthcare providers, hospitals, and health systems are working to ensure appropriate handling of sexual misconduct allegations. Many healthcare providers are revisiting their policies and procedures regarding incidents of alleged sexual misconduct. Such allegations may trigger peer review proceedings, which are confidential and conducted separately from a human resources investigation.
Further, hospitals and health systems must comply with state and federal reporting requirements as well as applicable National Practitioner Data Bank reporting guidelines. Whoever alleges the misconduct--medical staff or employees or patients--counsel to the healthcare organizations must ensure processes are in place to handle claims of sexual misconduct and investigate allegations.
