Course Details

This CLE course will examine the current employment issues related to return to work policies and the COVID-19 pandemic. The panel will address the potential of vaccination requirements, leave requests, ADA accommodations, and workers' compensation issues affecting their current workforce. The program will discuss best practices for handling requests and concerns that employees may have related to COVID-19 and exposure in the workplace.

Description

While COVID-19 continues to spread in the U.S. and the CARES Act provisions are expiring, employers are left without clear guidance on the legal issues that may arise as their workforce returns to the office. Employment counsel must guide clients in navigating myriad legal considerations, including potential areas of liability under federal and state employment laws, and advise them on effective tactics to ensure legal compliance and mitigate risk.

CEOs and HR personnel face the question: Can and should an employer require workers to get the COVID-19 vaccination? Vaccination requirements must comply with the Americans with Disabilities Act, Title VII of the Civil Rights Act of 1964, and other workplace laws.

Employers must prepare for FMLA requests by immune-compromised employees or those who develop a contagious virus or whose spouse, parent, or child suffer from medical issues due to illness. Further, if an employee becomes ill after return to work, employers must be prepared for the potential of workers' compensation claims.

Workplace safety is always a high priority. How do OSHA requirements apply when determining the best means of protecting workers from workplace hazards? Employment counsel must also guide their clients in understanding and meeting their obligations.
