This CLE course will provide guidance to employment counsel, gig businesses, and those businesses relying on gig workers on how to address common legal issues and mitigate risks stemming from the emerging gig economy. This program will examine the gig economy's impact on employers across multiple industries with respect to worker classification, state and federal regulations, and exemption issues.

Description

Typically, businesses offering platforms for gig workers or businesses utilizing these workers through platforms are forced to wade through myriad tests and regulations at the federal and state level. If the business operates in multiple states, there may be dozens of related - although different - tests applicable. This framework has created numerous regulatory and strategic questions for businesses. Additionally, the recent Dynamex decision in California concerning worker classification and several state safe harbors laws have raised further questions in the gig economy about worker classification.

In addition, state and local lawmakers are considering and enacting other laws regulating gig workers, notably those mandating paid sick leave and portable benefits. New York City recently passed the nation's first minimum pay rate, guaranteeing $17.22 per hour for drivers for ride-hailing apps like Uber and Lyft.
