This CLE webinar will bring to life civil procedure and evidence classes for new litigators learning how to prepare for and take depositions. The webinar will showcase a senior litigator coaching a beginning attorney about depositions and then responding to the new litigator’s questions by demonstrating, not just stating, the answers.

Mr. Cochran represents individuals and businesses in a wide variety of matters. He has tried jury trials, bench trials, administrative and regulatory hearings, and medical peer review hearings. He has appeared on many panels and spoken at seminars on a variety of topics, including the application of the Daubert rule and a host of topics related to white-collar criminal law and investigations.

Mr. Gardner Culpepper III is a Partner in the Litigation Practice of Smith, Gambrell & Russell, LLP. He specializes in complex commercial litigation and class action defense. Mr. Culpepper handles disputes involving trade secret misappropriation, insurance recovery (policyholder representation), indemnity, tortious interference, defamation, misrepresentation and fraud, products liability, fiduciary duties, false advertising, breached warranties made to consumers or in acquisition agreements, restrictive covenants, and high-value contracts. He also spent much of his career as national counsel for a manufacturing client, successfully defending against multiple statewide putative consumer class actions filed across the eastern United States and involving breach of warranty and product liability claims. Mr. Culpepper has been frequently recognized over the years as one of Georgia’s top commercial litigators and class action lawyers in third-party publications such as Benchmark Litigation, The Best Lawyers in America®, and Super Lawyers. He is also a Martindale-Hubbell AV Preeminent Top Rated Lawyer, and ranked by Chambers USA. In 2009, Mr. Culpepper was identified by Atlanta’s Daily Report as one of the top 12 lawyers under 40 in Atlanta. He also regularly speaks at Georgia CLE’s on ethical and professionalism topics.

Ms. Jimenez Garcia is an Associate in the Litigation / Trial Practice Department of Smith, Gambrell & Russell, LLP.

Ms. Zadnichek works closely with firm leadership to design and implement innovative programs and policies to attract, develop, engage, and retain legal talent. She is responsible for attorney training and professional development initiatives, including attorney orientation, integration, continuing legal education, mentoring, coaching, and performance management. Ms. Zadnichek is an active member of the National Association for Law Placement (NALP), the Professional Development Consortium (PDC), and she is certified in Mental Health First Aid.

Mr. Tai leads the IT Support Center that provides hardware and software support to the attorneys and staff at SGR. He is also responsible for the Audio/Visual Teams that provide on-site conference room support and technical expertise on the various videoconferencing software, including Zoom, Microsoft Teams, Cisco Webex, and Google Meet.

Learning to take effective depositions never ends, but it starts with mastering basic deposition procedures, evidentiary rules, best ways to prepare for different kinds of witnesses, dealing with resistance from opposing counsel, stipulations, importance of admissible evidence in deposition, organization techniques for documents and questions, and asking clear questions.
Sometimes the best way to teach these things is to show them in practice and in real time, but attorneys cannot stop actual depositions and call time outs to explain to new associates what is really happening. In this program, however, our senior litigator will combine instruction with actual demonstrations of deposition questioning and with hopes the audience will “try these at home.”
