This CLE course will provide guidance for counsel to companies doing business internationally on key considerations to protect their trademarks. Market globalization has a significant impact on protecting and enforcing trademark rights. In operating a global business, a company will encounter potentially infringing activity and objectionable trademark filings by third parties. Counsel should establish criteria for determining when to start an infringement action against the potential infringers.
IP protection methods have not developed as quickly as the global marketplace. Some countries changed their trademark laws and systems, which present new challenges for IP owners. In 2014, China’s PRC Trademark Law went into effect and in 2016, Mexico amended its Industrial Property Law and created a formal trademark opposition system.
Counsel must navigate trademark laws throughout the world to effectively enforce a company’s marks. Trademark owners should also seek to prevent confusingly similar marks and third-party use of its mark on counterfeit goods.
