This CLE course will provide guidance to counsel on the National Environmental Policy Act (NEPA) review process in light of the implementation of the Fixing America’s Surface Transportation Act (FAST Act). The panel will discuss the implications of the NEPA reforms and will provide best practices for operating under the new process.

Description

The FAST Act, which President Obama signed Dec. 2015, includes reforms for the NEPA environmental review process with important implications for businesses. FAST Act provisions establish new obligations for federal agencies that are subject to NEPA compliance when processing permits, licenses, renewals, amendments and other federal approvals.

Businesses will particularly feel the impact of the changes in the arenas where the NEPA review process is delayed beyond the standard timelines provided by the agency. The reforms can minimize the sources of delay and provide more certainty in the review process.
