Veteran Bankruptcies: Unique Debtor and Creditor Issues Under the HAVEN Act and SCRA

Description

Veterans and those on active duty are entitled to special treatment with respect to certain debt collection and consumer credit scenarios. Spouses, dependents of servicemembers, and some co-borrowers may also be entitled to the same protections under certain circumstances.

The SCRA addresses interest rates, motor vehicle repossession, mortgage foreclosure, illegal fees, auto lease termination, and cell phone contract termination. Violations of the SCRA create a private right of action for monetary damages and may precipitate the need to file bankruptcy.

The HAVEN Act excludes certain benefits paid to veterans or their family members from the definition of current monthly income (CMI) in the Bankruptcy Code, making it easier for them to file Chapter 7. But many other issues related to military service, such as security clearance, may be of concern.
