Veterans and those on active duty are entitled to special treatment with respect to certain debt collection and consumer credit scenarios. Spouses, dependents of servicemembers, and some co-borrowers may also be entitled to the same protections under certain circumstances.
The SCRA addresses interest rates, motor vehicle repossession, mortgage foreclosure, illegal fees, auto lease termination, and cell phone contract termination. Violations of the SCRA create a private right of action for monetary damages and may precipitate the need to file bankruptcy.
The HAVEN Act excludes certain benefits paid to veterans or their family members from the definition of current monthly income (CMI) in the Bankruptcy Code, making it easier for them to file Chapter 7. But many other issues related to military service, such as security clearance, may be of concern.

Admitted to the Commonwealth of Virginia’s Bar, she is also licensed in the U.S. District Court, the U.S. Bankruptcy Court for the Eastern District of Virginia, and the U.S. Court of Appeals for the Fourth Circuit. Ms. Morgan has devoted the majority of her practice to representing both individuals and business debtors. She handles Chapter 7 and Chapter 13 filings, tax debt resolution, creditor negotiations, and non-bankruptcy alternatives. Ms. Morgan works closely with clients to preserve assets and minimize liability, while also preventing future issues.
