The panel will describe how these programs interact, discuss the potential impact on benefit amounts and claims settlement, and offer best practices for helping clients navigate any additional administrative requirements.
Faculty

Ms. Atkinson practices workers’ compensation litigation defense, representing insurance carriers, large self-insured businesses, and third-party administrators in all issues resulting from work-related injuries. She represents clients hailing from a variety of industries including retail, transportation, insurance, pharmaceutical, manufacturing, among others. Ms. Atkinson’s clients typically have operations that span across large regions or are spread throughout the nation. As a result, she has handled a myriad of cross-jurisdictional worker’s compensation matters affecting businesses with a wide breadth of locations. In addition, she defends clients in cases involving chemical exposure, jurisdictional questions, and employment issues. Ms. Atkinson is a published author and experienced presenter on various workers’ compensation matters.

Ms. Maldonado’s practice is concentrated on Medicare compliance issues that arise in workers’ compensation and general liability settlements. Prior to joining the firm, her practice involved Social Security disability and workers’ compensation litigation as an Attorney Representative at a clinical and claims management services company and as an Associate at a solo practice. A registered attorney with the United States Social Security Administration, she has vast knowledge of and experience with Medicare, Medicare Set Asides, and workers’ compensation law in Pennsylvania.
Description
Many claimants who receive workers' compensation payments do so while receiving other public benefits like SSDI, Medicare, Medicaid, or payments through state disability programs. Counsel should understand how workers' comp interacts with other public benefits programs and the impact it may have on workers' comp benefits and settlement agreements to help manage claimants' expectations and guide them through any additional administrative obligations.
For example, parties on Medicare who are resolving workers' comp claims must adhere to the Medicare Secondary Payer Act (MSPA) and its various reporting and reimbursement obligations to ensure Medicare cannot seek potential reimbursement of paid medical expenses or impose penalties for noncompliance.
Where a claimant is unable to return to work and must apply for SSDI benefits, the amount to which they are entitled may be affected. The general rule followed by SSDI is that if a worker receives workers' comp and SSDI benefits, the total combined amount cannot exceed 80 percent of the worker's average current earnings before they become disabled.
Additionally, where a claimant is entitled to Medicaid, a needs-based program, workers' comp payments may affect a claimant's eligibility for continued Medicaid benefits.
