This CLE webinar will examine the latest legal developments in state and local employment laws. The panel will discuss changes in paid sick and family leave, legislation that has increased minimum wage, and how employers can enact policies that conform with changes to pregnancy accommodations and recreational cannabis use. The panel will also discuss best practices for counsel to employers when drafting and implementing employment policies related to these changes.
Faculty

Ms. Tellado focuses her practice on the representation of employers in all aspects of employment and labor law, with a particular emphasis on wage-and-hour complex collective, class and representative litigation, as well as discrimination and harassment claims. Her extensive experience representing employers in nationwide class and collective actions and complex employment litigation includes the defense of alleged overtime, minimum wage, off-the-clock, classification of exempt or nonexempt overtime status, misclassification as an independent contractor or contingent worker, and meal and rest break claims. Additionally, Ms. Tellado counsels employers on compensation plans to ensure legal compliance, as well as provides guidance on wage-and-hour issues related to compensable time, wage deductions and commissions, and off-the-clock liability and employer classification issues. She also counsels clients on workforce reductions, workplace investigations, hiring processes, disability accommodations, medical leaves, termination and discipline decisions, senior management contract negotiations, severance negotiations, employee handbooks and policies, arbitration agreements and other workforce issues.

Mr. Kamen practices in Florida and New York where he litigates employment disputes of all types, from single-plaintiff lawsuits to class and collective actions. He counsels employers on hiring, discipline, and termination of employees, as well as numerous other employment issues to ensure compliance with local, state and federal employment laws. Mr. Kamen also provides training and guidance to managers and employees with respect to complying with employment statutes to reduce the risk of litigation. Prior to joining the firm, he served as senior litigating counsel in the Labor and Employment Law Division at the New York City Law Department where he served as lead counsel for the City of New York, the New York City Department of Education and the NYC Health + Hospitals in high-stakes litigation involving their employment practices.
Mr. Pearlman is Co-Head of the firm's Whistleblowing and Retaliation Group and focuses on defending complex employment litigation involving claims of discrimination, harassment and retaliation; wage and hour laws; breach of contract; and restrictive covenants. A sought-after commentator on a range of legal issues, Mr. Pearlman has presented alongside the Solicitor of the DOL, appeared on Bloomberg News, and is regularly quoted in leading publications such as The Wall Street Journal.

Over 100 new labor and employment laws and ordinances took effect between July 1, 2021, and Nov. 1, 2021. While some of these laws address COVID-19 and topics concerning return-to-work, most mark a renewed attention to other hot topic labor and employment issues. Several states and localities have adopted or expanded nondiscrimination statutes to recognize new protected classifications. Other popular topics include independent contractors and worker classification, cannabis use and drug testing in the workplace, and repairs to state unemployment insurance systems.
Many states have also increased employer requirements for paid sick leave or paid family leave. Pregnancy accommodations and disability claims are also trending up at the state and local levels. Significant employment law changes in certain large states such as California, New York, and Pennsylvania may affect employers even as the labor force spreads across the country.
