Trademark clearance searching evaluates whether a trademark you want to use is identical or confusingly similar to trademarks that already are registered or are pending applications for registration. Unregistered marks can also be identified and assessed. Search tools that are powered by AI can be used to assist companies in selecting names and creating logos and to help trademark counsel in conducting searches and evaluating the results.

Use of AI can save time and money, as well as reduce the risk of human errors, but also poses some new risks. Trademark counsel must understand and weigh the benefits and the risks involved in using AI when conducting trademark searches.

Mr. Asbell serves as an adjunct professor of law and frequent guest lecturer at Fordham University and The Benjamin N. Cardozo School of Law (Yeshiva University), and has taught at Columbia University and the Instituto Superior de Derecho y Economia (ISDE) in Madrid, Spain. He regularly mentors new lawyers and law students.

Mr. Rubin is based out of New York as a Commercial Executive at Corsearch - evangelizing the suite of products/services and closing new business opportunities to new and existing customers. He has been with Corsearch nearly 19 years, starting in 2005 as a Trademark Researcher, eventually managing the North American Operations department. In 2014, Mr. Rubin moved into a more customer facing role, managing the Product Support and training department, where he educated clients on how to best use Corsearch's products and services. In 2017, Mr. Rubin incorporated the selling and promotion of Corsearch’s international products into his role. In 2020,  he joined the Commercial team full time.

Ms. Winston focuses her law practice primarily in the areas of trademarks, copyrights, and the internet, representing a broad range of both domestic and international clients from individual business owners and small startup ventures to established Fortune 500 and publicly traded companies. She is known for her strategic counseling when registering trademarks and has been referred to as a litigation avoidance advocate due to her thoughtful and creative solutions for avoiding or resolving disputes. She covers the full gamut of trademark services, whether it involves transactions, searching and clearance, acquisition and registration, opposition and cancellation proceedings, and domain name dispute resolution. In the circumstances where it is not possible to stay out of the courtroom, Ms. Winston is prepared and willing to handle litigation matters on behalf of her clients.
