This CLE webinar will offer attendees a detailed analysis of why juries award runaway verdicts and how juries calculate them. The panel will discuss the impact of the current litigation climate on claims where coverage issues are present and the effect of the current litigation climate on excess and umbrella coverage.
Faculty

Ms. Baker is a partner in the firm’s Philadelphia office. Her practice focuses on medical malpractice, oral and maxillofacial surgery and dental malpractice, professional licensing and premises liability defense. She also has experience in transportation and appellate work, has developed and presented continuing medical education (CME) materials for medical practitioners, and has been honored to be a speaker at professional conferences.

Ms. Fulton is an AV-Rated attorney and forensic accountant who manages the firm’s Florida office. Her national practice of more than 23 years focuses on bad faith/insurance coverage litigation, commercial litigation, construction litigation, professional malpractice defense (including the defense of lawyers, medical professionals, medical device manufacturers, and construction professionals), and class action defense. Ms. Fulton litigates in both trial court and appellate courts.
Description
Most lawyers have never seen a so-called "nuclear" verdict, nor do they truly appreciate how one comes into existence. Being able to recognize the types of factors that give birth to nuclear verdicts and recognize the danger before the situation blows up allows counsel and their clients a chance to settle these claims and avoid these verdicts.
Likewise, most attorneys also do not understand the often unprecedented ways that juries actually calculate the dollar amounts awarded and how those methodologies may differ drastically from traditional approaches. This panel will offer insights from actual cases that can help attorneys understand what they are up against.
