This CLE course will examine the strategic issues and decisions litigators must face in class action lawsuits against insurance companies. The panel will offer guidance on class certification, the utility of dispositive motions, navigating the discovery process, as well as settlement strategies.
Faculty

Mr. Stern is the head of the firm’s Insurance Litigation Division. As a trial and appellate lawyer, he has extensive experience with respect to coverage, bad faith, reinsurance and regulatory disputes, spanning multiple lines, including specialty, professional, excess and general liability. His work representing insurers has earned him a spot on numerous leading lawyers lists, including Chambers USA (both the Nationwide and California lists), Legal500, and Martindale-Hubbell.

Ms. Kokolis has a special practice emphasis on complex and appellate litigation, particularly the defense and settlement of class actions. She has litigated dozens of class action suits in federal and state trial and appellate courts involving insurance coverage and claims practices, as well as constitutional cases, consumer fraud and product liability, among others.

Mr. Drocton is a commercial litigator, focusing his practice on class action defense and the insurance industry. He also advises financial services clients on regulatory compliance matters and assists with internal investigations and government proffers. Mr. Drocton's practice spans state and federal courts, from initial case evaluation to trial preparation and appeal. He has experience with briefing dispositive motions, conducting and defending fact and expert witness depositions, managing large-scale e-discovery projects, drafting appellate briefs and overseeing class settlements.
Description
Class actions against insurance companies frequently assert policyholder claims challenging the manner in which insurance products were sold--including their cost--the way claims were handled, or both. Different certification and settlement issues and strategies may be more appropriate for these different categories of claims.
Property, title, auto, life, and casualty insurance products have all been the subject of class action claims. The increased use of algorithms in pricing and claim adjustment is often challenged, with plaintiffs seeking to discover what factors were used to set premiums or value losses.
