This CLE webinar will guide ERISA counsel, fiduciaries, and administrators on federal regulation reporting requirements and compliance challenges. The panel will discuss critical issues plan sponsors and administrators face, the impact of the Consolidated Appropriations Act (CAA) of 2021, new mental health parity rules, and key requirements under the Affordable Care Act (ACA), COBRA, ADA, CARES Act, and GINA.

Ms. Watson focuses on ERISA and employee benefits. She concentrates on a wide array of areas including, pension and profit sharing plans, health and welfare benefit plans, including COBRA, HIPAA and the Affordable Care Act, ERISA fiduciary decision-making, Employee Stock Ownership Plans, benefits litigation backup, benefits aspects of mergers and acquisitions, employee benefits aspects of family law, labor laws affecting employee benefits, other employee benefits and deferred Compensation, and employee benefit disputes and employee benefits claims.

Mr. Klimpl is a seasoned attorney with experience providing ERISA advice and related services to a variety of plan sponsors and employee benefit plans, including corporate, nonprofit, multiemployer and governmental plans providing retirement, health, disability, dental and other welfare benefits. In the field of executive compensation, he has assisted both employers and employees with equity and incentive compensation, nonqualified deferred compensation, Section 409A questions, and executive employment and severance agreements. Among other industries, Mr. Klimpl has represented clients in the financial, construction, medical, fashion, real estate and legal industries. He chairs the Fairfield County Bar Association Employment Law Committee.

Ms. Delano concentrates her practice in employee benefits law, executive compensation and taxation. She counsels clients on all aspects of employee benefits design, implementation, termination, and compliance for retirement plans, health and welfare plans, and executive and incentive compensation arrangements. In the process, Ms. Delano focuses on comprehensive, practical and innovative employee benefits solutions for all types of employers
Description
The DOL has substantially stepped up enforcement actions in response to the increase in health plans that fail to comply with certain standards and requirements under the CARES Act, CAA, ACA, and other federal regulations. ERISA counsel, fiduciaries, and administrators must ensure strict compliance with current regulations and implement procedures to ensure compliance.
The administrative challenges and compliance failures for health and welfare plans can lead to lawsuits and significant penalties. In addition to reporting requirements, plan sponsors and administrators must ensure that health plans comply with various federal statutes, regulations and agency guidance under, among other laws, the ACA, COBRA, ADA, CAA, GINA, and the new mental health parity requirements. Each of these laws significantly impacts the administration and fiduciary obligations for health plans.
The critical areas of the DOL's focus for audits and enforcement will include mental health parity compliance, ACA requirements, discrimination, self-dealings, cybersecurity, and other critical areas of compliance. ERISA counsel must identify potential compliance pitfalls and understand the required documentation and procedures under the applicable regulation, investigation/audit triggers, and plan provisions targeted by the DOL and IRS to minimize plan administration issues.
