Dr. Brambrink advises and represents clients in complex patent disputes on all IP-related matters, often at the interface of antitrust and regulatory laws. Her expertise covers various fields of technology with a focus on pharmaceuticals, biotechnology, med-tech, as well as renewable energies and high-tech. As a patent litigator, Dr. Brambrink represents clients in infringement, preliminary injunction and inspection proceedings before German district and appeal courts as well as in nullity and compulsory license proceedings at the German Federal Patent Court and the Federal Supreme Court. In addition to her work as a litigator, Dr. Brambrink advises clients strategically on all issues relating to intellectual property rights (patents, utility models, supplementary protection certificates), such as contracts for the licensing and transfer of rights also in connection with international transactions or the newly established Unified Patent Court. She has extensive experience in the European coordination of multinational patent disputes. Renowned pharmaceutical, biotechnology and medical devices companies regularly seek her advice. Dr. Brambrink also advises in the field of renewable energies and in the enforcement of standard-essential patents.

Mr. Gramenopoulos has more than 20 years of experience in the field of intellectual property law. He handles patent matters for emerging and high-technology companies in various electrical sciences, including computer hardware/architecture, software, communication networks, and digital signal processing and control systems. Mr. Gramenopoulos counsels both domestic and foreign clients. A significant portion of his current practice is devoted to strategic counseling on patent procurement and pre-litigation activities, opinion preparation on issues relating to infringement and validity, and patent infringement litigation. He has a significant base of European clientele, gained in part through his five-year tenure in the firm’s European office in Brussels. Through his knowledge of both U.S. and foreign patent systems, Mr. Gramenopoulos applies a unique global perspective to advise clients on worldwide filing and licensing strategies. He has also successfully represented clients in U.S. district court and multi-national patent infringement suits. Mr. Gramenopoulos has overseen the drafting and prosecution of hundreds of patent applications, and assisted clients with strategically building and managing their portfolios. He has also assisted clients with extracting value from their portfolios through licensing and other strategies. A frequent lecturer on U.S. IP law, Mr. Gramenopoulos has spoken before numerous Fortune 500 companies and organizations in the U.S., as well as various multi-national companies and law firms throughout the world and served as leader of the firm’s electrical and computer technology practice group.

Dr. Moritz Meckel is a patent litigator in Finnegan’s Munich office. He holds a Ph.D. in physics and is one of only a handful of lawyers in Germany admitted as an attorney at law, a German patent attorney, and a European patent attorney. He represents clients in contentious matters relating to a wide range of technologies such as materials science, electronics, optics, medical devices, automotive, and mechanics.

The UPC opened for business in June 2023. The creation of the UPC is the most significant change in European patent litigation landscape in 50 years. Since the start of operations on June 1, the court has received over 340 cases through the end of April 2024. It is important to look at emerging trends and what can be learned from the key decisions of the court in the first year.
The UPC is an attractive forum because it has a broad reach and can decide preliminary injunctions as well as first and second instance decisions in a timely manner. The UPC also allows for forum shopping. For example, more infringement actions are being filed in Germany, which is known as one of the best patent litigation venues.
Things continue to develop at the UPC, and questions remain. It is important for patent holders and challengers alike to understand how things have evolved at the UPC over its first year and what lessons can be learned.
