New Section 25F Education Freedom Tax Credit and Recent IRS Guidance

Temporary and Proposed Regulations, State Participation, SGO Qualifications, Student Eligibility, Reporting and Audit Requirements

About the Course

Introduction

This CLE/CPE webinar will cover the new Section 25F Education Freedom Tax Credit, including who is eligible, the credits available, and the related IRS guidance outlining temporary and proposed regulations. Our panel will discuss the rules under Sec. 25F, recent IRS guidance, and analyze the potential impact of temporary and proposed IRS regulations. The panel will also take a deep dive into qualification for scholarship-granting organizations (SGOs) receiving contributions, student eligibility and verification, reporting requirements and audits, and other key items.

Description

In January 2027, some taxpayers may be eligible to receive a federal tax credit for contributions to SGOs under Section 25F. This new tax provision was enacted under the One Big Beautiful Bill Act and aims to provide tax incentives to taxpayers who contribute to qualifying organizations that fund K-12 educational scholarships.

Recent IRS guidance provides that contributions made on or after Jan. 1, 2027, by taxpayers who are U.S. citizens or residents can claim a federal income tax credit. These contributions must be made to qualified SGOs that meet strict criteria provided under the regulations. In addition, states, donors, both private and public schools, and education service providers intending to participate are also expected meet certain compliance obligations.

Listen as our panel discusses new Section 25F and the most recent Treasury guidance, qualification for SGOs receiving contributions, student eligibility and verification, reporting requirements and audits, and other key items.
