About the Course
Introduction
This CLE/CPE webinar will provide employee benefits counsel and advisers a detailed analysis of Section 530A Trump Accounts and the latest guidance regarding setting up these accounts and employer contributions. The panel will discuss structuring the account, required plan documents, eligibility requirements and beneficiary certification procedures, contribution limits, employer-funded contributions, and investment restrictions.
Description
The One Big Beautiful Bill Act ushered in the establishment of Trump Accounts, which opened for contributions on July 4, 2026. It allows deposits of up to $5,000 annually by parents, grandparents, and others for children under the age of 18, while also allowing employers to make tax-free contributions of up to $2,500 under Section 128.
In addition, children born in 2025-2028 can receive a $1,000 federal contribution if they meet certain eligibility criteria and an election must be made with Form 4547 to claim it. The IRS has stated that eligible children who have not established an account will be automatically enrolled. Benefits counsel, tax advisers, and employers must navigate several nuances stemming from applicable federal rules, such as necessary plan documentation for employers, recent DOL guidance and ERISA, contribution restrictions, nondiscrimination testing, beneficiary certification, and other key issues.
Listen as our panel discusses the latest guidance for Trump Accounts, outlines the benefits and drawbacks of contributing to them, compares these accounts to Section 529 plans, and addresses other key issues.
