Introduction

This CLE webinar will provide attorneys with a practical foundation for understanding the energy industry, the energy project lifecycle, and the regulatory and commercial framework for energy projects.

Description

The panel will examine the roles of FERC, state public utility commissions, regional and independent transmission organizations (RTOs and ISOs), utilities, developers, investors, lenders, project owners, and federal, state, and local permitting authorities. The discussion will address how projects move from origination and site control through permitting, interconnection, financing, construction, operation, and market participation.

The panel will also review the customary critical agreements underlying an energy project development. These include power purchase and offtake agreements, interconnection agreements, site control documents, engineering/procurement/construction (EPC) contracts, and operations/maintenance arrangements.

Mr. Nugent is a senior counsel in Norton Rose Fulbright's energy projects group based in Denver. He represents electric utilities, power producers, private equity, transmission and generation developers, cooperative and utility customers on electric, natural gas and refined products matters before the Federal Energy Regulatory Commission and state public utility commissions. Mr. Nugent commonly works on asset purchase and sales, project development, financing, interconnection and transmission service, ratemaking, legislative and regulatory strategy, negotiation and litigation, contracting and a broad range of regulatory compliance matters.
