The divorce rate among adults aged 50 and older has continued to rise, with nearly a third of all divorces now involving this age group. Family law practitioners must be well-prepared to handle the unique challenges of grey divorce. Grey divorces often involve complex financial entanglements, long-term asset division, and sentimental items that require careful consideration.

Older adults who divorce tend to have lower asset bases compared to those who remain married, with grey divorced individuals possessing only a fraction of the wealth of younger married couples.

Complex issues surrounding the revocation of wills, trusts, and medical directives; the maximization of retirement assets; the division of long-held real estate; and long-term care planning often arise. Life insurance considerations are also critical due to the increased likelihood of death before the end of spousal maintenance obligations.
