This CLE webinar with a nationwide panel with some of the leading and most respected minds in this space will offer guidance from plaintiff and defense counsel on trying high stakes sexual abuse cases. The program will offer direction on case evaluation, presuit settlement negotiations, litigation vs. mediation, discovery, timing, and even some ethical considerations to be considered at each step.
Faculty

Mr. Merson has litigated medical malpractice, wrongful death, negligence, defective products and product liability, wrongful termination, harassment and discrimination cases, class actions and personal injury claims that have settled for multiple millions of dollars.

Judge Cunningham serves as the Supervising Judge for the Complex Civil Litigation Program, presiding over product liability cases, consumer protection class actions, labor-related class actions, and mass torts. Gov. Arnold Schwarzenegger appointed him to the Los Angeles Superior Court on January 22, 2009.

Mr. Dowden has over two decades of experience advising companies, institutions and individuals in enforcement proceedings brought by federal, state and foreign government agencies. A former federal prosecutor and U.S. Supreme Court clerk, Mr. Dowden is highly regarded for his exceptional investigative skills and for his integrity in handling matters that are extremely delicate in nature. He has substantial experience conducting thorough, independent investigations into allegations of serious wrongdoing, including workplace harassment, corruption, and unlawful or unethical business practices. Mr. Dowden has represented numerous organizations in bet-the-company investigations by the U.S. DOJ, the SEC and other regulatory agencies in the life sciences, private equity and financial services sectors. He holds leadership positions at Ropes & Gray. A member of the litigation and enforcement practice group, Mr. Dowden is also a co-leader of the firm’s government enforcement / white collar criminal defense practice, and a co-leader of the independent investigations group, which handles a range of complex and highly sensitive investigations for organizations in need of transparent, impartial third-party assessments.

The Hon. George J. Silver, managed all the Child Victims Act cases filed in New York City. In July 2017, he was appointed Deputy Chief Administrative Judge for New York City Courts and was responsible for handling the day-to-day court operations for the Trial Courts in New York City. In October 2021, Justice Silver retired from the bench to open his mediation company- Silverstar Mediation and Arbitration LLC.

Because many states have reopened the statute of limitations for child sexual abuse claims, tens of thousands of civil cases have been and are continuing to be filed against both individuals and institutions where they may have been employed or volunteered.
These cases can be challenging as well as rewarding, but the client may require special attention. This program will discuss proving the elements of the claims, damages, and finding insurance coverage, as well as advantages and pitfalls of both mediation and litigation.
