Increased State Scrutiny of Pharmacy Benefit Managers: Legislative Update, Litigation Challenges, Notable Settlements

About the Course

Introduction

This CLE webinar will examine the increased state scrutiny of pharmacy benefit managers (PBMs) and attempts to legislate greater transparency and lower prescription drug costs. The panel will discuss notable state legislation and PBM litigation challenges. The panel will also discuss PBM settlements with the states for violations. Finally, the panel will address the potential impact on stakeholders and on other state attempts to regulate PBMs.

Description

PBMs face increased scrutiny from federal and state lawmakers. While the federal government continues to consider and enact PBM reforms, including as part of the 2026 Consolidated Appropriations Act focused on increased transparency, standardized reporting, and rebate pass-through, the states have also advanced legislation targeting PBMs.

Areas in which state legislators have focused in an attempt to increase transparency and lower prescription drug costs include gag clause prohibitions, limits on PBM steering to affiliated pharmacies, rebate transparency, and clawback prohibitions.

States are also targeting the PBM ownership structure with attempts to limit the vertical integration in the pharmaceutical supply chain by imposing ownership transparency and disclosure requirements. However, the PBMs are pushing back as demonstrated by the Arkansas statute recently found to be preempted by ERISA and the Tennessee statute currently being challenged by three PBM lawsuits.

Additionally, state AGs and insurance commissioners have become involved in attempting to rein in PBMs by using their existing authority under consumer protection, insurance, and pharmacy regulations to investigate and extract notable settlements from PBMs for violations.

With the ongoing question as to how far states can regulate PBMs on the one hand and settlements with the states costing PBMs millions of dollars on the other, counsel for stakeholders should be up to date on state legislation and enforcement actions targeting PBMs.

Listen as our expert panel provides an update on the increased scrutiny of PBMs by the states, discussing notable legislation and settlement actions as well as litigation challenges. The panel will also address the potential impact on stakeholders and other states that may be contemplating PBM legislation.
