This CLE course will provide new attorneys with a comprehensive overview of regulatory considerations when using electronic contracts and signatures (e-contracts and e-signatures) in the healthcare industry. The panelist will discuss regulatory compliance in accordance with HIPAA, ESIGN, UETA, and FDA as well as an overview of the most recent CMS guidance. The panelist will also address risk assessments that covered entities must balance in each transaction and offer best practices for compliance.

With the expanded use of electronic transactions and e-signatures in healthcare, it is vital that counsel understand the complex and overlapping regulatory landscape to assist clients with remaining compliant.

The use of e-signatures is allowed under HIPAA, but users must have systems in place to ensure the agreement or authorization is legal and secure so that private health information is not at risk. Additionally, most healthcare providers will also need to comply with CMS and other regulatory signature requirements. Basic compliance mistakes when using e-signatures can expose healthcare providers to potential liability.
