Introduction

This CLE webinar will provide new real estate attorneys with an overview of the types of involuntary liens commonly filed against real property owners, address notice requirements and drafting considerations for creating a lien, and discuss how real property owners may dispute and/or remove a lien.

Description

Creditors may place involuntary liens on real property to recover an unpaid debt or obligation which subsequently has a significant impact on the real property owner, including, among other things, clouding the title and blocking the sale or refinancing of the property.

Common types of involuntary liens that may be filed against real property owners include: (1) mechanic's liens for failure to pay for work or repairs completed by a contractor; (2) HOA liens for missed payments or dues; (3) tax liens (e.g., federal and property) for failure to pay taxes; and (4) judgment liens for other unpaid bills or dues.

Counsel should understand the types of liens frequently filed against real property owners, when they should be used, and the transactional requirements for creating a lien, and, if representing the real property owner, how to dispute and/or remove a lien from the property.
