This CLE webinar will examine common zoning disputes facing real estate developers. The panel will offer best practices for guiding clients through any administrative processes that may be required to attempt to resolve disputes, discuss alternative dispute resolution, and address litigation strategies where other efforts fail. The panel will also discuss how counsel may help clients mitigate the risk of future disputes during project planning.
Description
One of the critical issues facing real estate developers is navigating zoning requirements and potential disputes that, if they arise, can significantly impact project timelines, costs, and feasibility. Counsel should be able to guide developer clients through pre-project planning to mitigate the risk of zoning disputes, and if they arise, help them navigate the administrative process, alternative dispute resolution, and possible civil litigation.
Common zoning disputes often center around variance requests that may be objected to by neighboring property owners; nonconforming use of the property that does not comply with local zoning ordinances and may be challenged by local authorities or neighboring property owners; and construction that may violate building restrictions contained in local zoning ordinances.
While zoning disputes may be resolved in any required administrative process, often these disputes end up in civil litigation. Therefore, it is imperative that counsel help their developer clients understand pre-project considerations to help mitigate zoning conflicts in the first place; and if they arise, guide them through any required administrative process, and, if needed, other dispute resolution, including ADR and civil litigation.

Presented By
Mr. Barshov’s areas of specialization include land use law, environmental law, local government law, real estate, as well as related litigation. Having represented numerous developers, businesses, municipalities, and community organizations in more than 30 years of practice, Mr. Barshov has handled projects of all sizes — from a large master planned community of 1195 units with a commercial center, to a small 3-unit subdivision, both inside and outside New York City. He has litigated in the U.S. Supreme Court; in federal courts in the Second, Fifth and Tenth Circuits; and at the New York Court of Appeals, Appellate Divisions, and trial courts in multiple counties. Mr. Barshov has been qualified as a land use law expert witness in Supreme Court, Nassau County. He has written and lectured extensively in his areas of expertise. Mr. Barshov is an adjunct Professor of Law at Brooklyn Law School where he has taught Land Use Law, State and Local Government Law, and Real Estate Practice.
Mr. Huntington represents his clients in the enforcement of their property rights. His clients include developers, landowners, contractors, builders, surety companies, condominium owners, landlords and tenants. Mr. Huntington represents landowners and contractors in litigation and negotiation adversarial to governmental subdivisions (counties, cities, townships, etc.) and government agencies, including matters involving eminent domain, inverse condemnation, zoning, administrative law and payment disputes. He litigates contract disputes and is passionate about obtaining justice when misrepresentations are made during a real estate transaction about the conditions of real property. Bryan is also a Rule 114 qualified neutral (mediator) in Minnesota.
