Many attorneys needlessly decline representing dog bite victims because they lack complete information and the right strategies to overcome the unique challenges these cases can present.
The first step is to identify all possible defendants and not overlook governmental entities or shelters. By recognizing the types of insurance coverage available through homeowners and other types of policies, and correctly understanding their terms, counsel can find overlooked sources of compensation.
It is also critical that plaintiff's counsel understand theories of liability in their jurisdiction, common defenses, and the role of animal control statutes and any breed-specific laws.
Counsel must also manage unique issues that can arise when witnesses or defendants are friends and family. If the case is to be settled, counsel must be aware of any settlement options, such as structured settlements, and when victims are children, special rules for court approval.
