Medical Product Liability: Was It the Device, the Doctor, or the Disease?

Linking a Patient's Injury to the Design, Labeling, and Post-Market Evidence Behind a Medical Device

About the Course

Introduction

This CLE webinar will discuss how to overcome the problem of siloing the analysis of a patient's injury from the analysis of a medical product's design, labeling, and post-market evidence behind the device. The panel will offer a unified framework for connecting a patient's injury to the design and regulatory records behind the device, identify which device records to request and why, and recognize when a question is clinical and when it is engineering or regulatory.

Description

In medical device injury matters, it is often difficult for even the most experienced practitioners to discern whether the source of the harm was the device, the doctor, or the disease. Attorneys usually see the injury through the medical record and see the device through the manufacturer's documents. Rarely do attorneys have one framework that effectively demonstrates the nexus between the medical record and the manufacturer's documentation.

That connection is often where the key questions sit. A complication can be (1) a known risk that the labeling disclosed, (2) a departure from the instructions for use, or (3) a device that did not perform as designed. Telling these different complications apart requires reading the medical record and the manufacturer's documents together.

Listen as our extraordinary panel of a physician, a medical device engineer and FDA regulatory and quality expert, and a litigator with medical device product liability experience shows the audience how to connect the patient's injury to the design, labeling, and post-market evidence behind the device using a composite hypothetical case.

I. The clinical picture: the presentation, disease process and causation, and questions an injury should raise about the device

II. The device behind the injury: what the device was cleared or approved for, and what the manufacturer had to show to obtain that clearance or approval

III. Tracing it to the record: design controls, verification and validation, risk management, and labeling—and what each should show

IV. The post-market trail: complaints, adverse event reports, and corrective actions, and what they mean clinically

V. The legal framework: theories of liability, how the FDA pathway affects preemption, and how clinical and device experts are used in these cases

VI. Putting it together: questions to ask early, and the records to request

The panel will discuss these and other critical points:

  • How to connect a patient's injury to the design and regulatory records behind the device
  • What device records should be requested, and why?
  • How can attorneys recognize when a question is clinical, engineering, or regulatory?
