Introduction
This CLE webinar will offer best practices for proving and defending post traumatic stress disorder (PTSD) claims and assessing appropriate compensation for survivors of car, truck, and even aviation accidents. The panel will consider what experts are needed to evaluate a PTSD diagnosis, causation issues, and compensatory and non-compensatory damages.
Description
PTSD, major depression, and anxiety disorders affect a significant number of persons involved in auto and truck crashes, as well as aviation incidents. Treatments include behavior and cognitive therapy, plus medications—all of which can continue indefinitely and can add up quickly.
Early recognition of PTSD symptoms and claims allows personal injury attorneys representing accident victims to lay the groundwork for proving that the accident caused or exacerbated PTSD, and thereby increase the value of the case and the likelihood of treatment and recovery. Defense counsel have a vested interest in early assessment, correct diagnosis, and evaluation of potential damages. Both sides will be focused on issues of causation and compensation for medical treatment and rehabilitation; therapy, counseling, and medications; lost wages and loss of future income; and pain and suffering.
Expert witnesses play a critical role in establishing causation and assessing damages in accident cases alleging PTSD. Both plaintiff and defense counsel will want to carefully vet the experts and ensure that their opinions will be admissible as well as persuasive.

Mr. Kemp is an attorney in the firm’s litigation division. He has been with the firm for several years, beginning as a law clerk. Recently, Mr. Kemp obtained an $8 million settlement, which was the largest settlement in the State of Michigan in 2024 according to Michigan Lawyer’s Weekly. The year prior, he obtained an $8.5 million truck accident settlement. While in law school, Mr. Kemp had the opportunity to first chair a felony jury trial at the Wayne County Prosecutor’s Office in Detroit. Prior to attending law school, he was a judicial intern for the Honorable Ronald Lowe in the 35th District Court.
Ms. Moody is an associate in the Las Vegas office of Lewis Brisbois. She represents and defends healthcare providers, clinics, and medical practitioners in complex medical malpractice litigation. Prior to joining Lewis Brisbois, Ms. Moody served both as a Law Clerk and a Judicial Intern at the Eighth Judicial District Court in Nevada. She was involved in criminal and civil matters, including specialty court and medical malpractice matters. Additionally, Ms. Moody served as a Congressional Intern for a United States Senator and as a Law Clerk at the Legal Aid Center of Southern Nevada. During law school, she served as the Student Bar Association President, establishing a scholarship endowment for future law school students. Ms. Moody earned a Dispute Resolution Concentration and graduated with the highest pro bono honors hours in her graduating class, accumulating over 500 hours.
