This CLE course will provide real estate counsel with a review and discussion on how to identify and resolve title defects and boundary issues arising from property surveys, easements, and encroachments. The program will analyze the various issues that give rise to these common matters and best practices for addressing them to close the deal.
Faculty

Mr. Glosser’s primary focus is real estate, business, and corporate law. His practice combines transaction and litigation. He has been actively involved in the real estate industry as a broker, manager, developer and attorney since 1978. Mr. Glosser is thoroughly familiar with all aspects of real estate transactions and financing. He brings his entrepreneurial experience to the practice of law, enabling him to understand both the legal and business issues presented in each transaction. As an attorney, he assists clients with understanding and evaluating legal issues associated with business transactions, enabling clients to analyze risk, and make informed business decisions. Mr. Glosser is a frequent speaker on a variety of real estate topics, both locally and nationally.

Ms. Wahlberg focuses her practice on the representation of clients in all aspects of real estate litigation and transactions, as well as commercial and business matters. Her practice emphasizes the representation of buyers and sellers of residential and commercial real estate and providing assistance with matters such as title disputes; boundary and survey disputes; easements, right of way and access issues; deed and contract preparation; mechanic’s lien disputes; representation in administrative proceedings for licensed professionals; and Torrens proceedings subsequent and registration proceedings. As a former in-house claims counsel with regional and national responsibilities, Ms. Wahlberg has extensive experience in handling title and escrow claims which assists title insurers and title agencies in meeting legal challenges. Her experience extends from curative actions and lien priority defense to coverage, as well as providing policy coverage opinions and coverage defense representation. Ms. Wahlberg’s experience working with title companies, developers, surveyors, appraisers, abstractors, examiners, and other real estate professionals allows her to identify, evaluate, and strategize on resolving real estate matters, with and without litigation.

Ms. Goldstein is a seasoned litigator with Schorr Law’s real estate litigation team. She prides herself on obtaining the best results possible and has established a track record of success at Schorr Law. She is a Los Angeles native who obtained her Bachelor of Arts degree in Psychology from the University of Southern California. Ms. Goldstein received her Juris Doctorate from Loyola Law School, Los Angeles, where she was a member of the International Law Review. During law school, Ms. Goldstein interned at the Office of the Attorney General for the State of California in the business, tax and licensing division and was a summer associate at a fast-paced general litigation firm where she gained practical experience in the areas of real estate and business litigation.

The goal of every real estate deal attorney is to ensure a timely and smooth closing of the transaction. Title defects and survey matters are just two of the many hurdles that transactional attorneys must clear.
While many risks can create an encumbrance or cloud on title, real estate practitioners regularly deal with title defects involving easements and undiscovered encroachments. Similarly, boundary/survey disputes often arise due to conflicting survey reports or historic occupation that may differ from what is shown on a survey.
Armed with the knowledge to cure common title defects, practitioners can ensure that they close real estate transactions on time and with few surprises. Title insurance may be an appropriate resolution of certain title defects.
