This CLE course will guide IP counsel on trademark protection after Brexit. The panel will discuss current EU registrations, renewals, and cancellations, as well as pending EU applications. The panel will address IP agreements and the importance of reviewing these agreements and considering whether any amendments must be made. The panel will also discuss the steps to ensure the protection of IP rights going forward.
Faculty

With experience in all aspects of international brand management, protection and enforcement, Mr. Poulter focuses on portfolio management, legal clearance searches, contentious registry proceedings and global branding strategies. Mr. Poulter has experience as a barrister, trademark attorney, solicitor and in-house counsel, when he spent three years as a director of the world's largest branding consultancy, and has represented the owners of many of the most recognized and valuable international brands. He oversees the management of numerous international trademark portfolios, working closely with clients to ensure their brand protection reflects and supports the commercial interest of the business. Mr. Poulter also assists with the smooth launch of new brands and the expansion of existing brands into new territories by identifying any potential risks and devising appropriate strategies to eliminate or reduce such risks to a commercially manageable level. Multi-jurisdictional disputes are becoming increasingly common and require careful management which he can provide through working closely with colleagues in our international offices and with carefully selected preferred firms in countries where we do not have an office.

Ms. Maynard guides her clients through all aspects of domestic and international brand-building and brand management. She analyzes and assesses the benefits and risks associated with adopting new brands, prepares and implements strategies for the development of new brands, and protects and expands established brands. Ms. Maynard represents clients before the Trademark Trial and Appeal Board and litigates cases involving complex trademark, trade dress, advertising, copyright and design patent issues in federal court. She also negotiates complex license and settlement agreements, advises on domain names and social media, and counsels on the proper use of trademarks and trade dress.
Description
The UK-EU Withdrawal Agreement went into effect on Jan. 31, 2020 and provided for implementing registered EU intellectual property rights into UK law after Brexit. EU trademark registrations were provided protection in the UK until the end of 2020.
For every EU trademark registration in force at year-end, unless trademark owners opted out, a cloned UK right was created automatically, and retained the filing date of the EU registration. No cloned right was automatically created for pending EU trademark applications; however, this is a nine-month grace period during which the owner of an EU trademark application pending at Dec. 31, 2020 can apply for a corresponding UK application.
