Course Details

This CLE course will guide energy counsel on the legal issues involved in the implementation of energy storage projects. The panel will discuss the markets, regulatory landscape, and legal challenges with energy storage, including obstacles that may arise when co-locating battery projects with wind and solar, and provide tips on how to draft and negotiate contracts for the implementation of such projects.

Description

Solar and wind power are now significant players in the electricity industry, but these projects are not without challenges on the electric grid. Energy storage is a solution to address these issues.

Due to an increased focus on energy storage systems, some states have adopted mandates and incentives for rapid deployment. Energy storage impacts multiple markets, each with different characteristics, different levels of regulatory uncertainty, and different cost-benefit analyses.

Counsel must understand the different ways that energy storage works, how storage is regulated and deployed, and the legal risks and challenges for projects. What issues should attorneys be watching out for in developing these projects and negotiating contracts for their implementation? What makes battery projects different from wind and solar?

Listen as our authoritative panel of energy attorneys examines energy storage, how it is implemented in the U.S., and how contracts for these projects work. The panel will discuss the risks and legal challenges involved with energy storage--including the obstacles for projects--and will offer guidance on overcoming those challenges.

Outline

  1. Energy storage markets, economics, and regulatory landscape
  2. Contracting for energy storage projects
    1. Types of contracts and contract structure
    2. Warranties
  3. Co-location of battery projects with wind and solar
    1. Whether to co-locate
    2. Key issues

Benefits

The panel will review these and other essential matters:

  • How is energy storage being used today?
  • What are counsel's key considerations when determining whether to co-locate renewable energy storage?
  • How does the size of a renewable project impact the legal risks and challenges of energy storage?
