This CLE course will guide energy counsel on the legal issues involved in the implementation of energy storage projects. The panel will discuss the markets, regulatory landscape, and legal challenges with energy storage, including obstacles that may arise when co-locating battery projects with wind and solar, and provide tips on how to draft and negotiate contracts for the implementation of such projects.
Faculty

Mr. Edney is a projects lawyer focusing on project development, mergers and acquisitions and joint ventures. He has significant experience working with conventional and renewable energy project developers, petrochemical companies and contractors on the acquisition, development and disposal of projects. Mr. Edney's experience extends to battery storage, wind, solar, carbon capture, microgrids, LNG, infrastructure (including ports, highways, rail, pipelines, high-voltage transmission) and conventional thermal power.

Ms. Gamache works with project developers, investors, utilities and financial marketers to find solutions to complex energy regulatory issues, develop ideas into operational projects, draft and negotiate material contracts and close deals. She routinely represents clients before the Federal Energy Regulatory Commission, the North American Electric Reliability Corporation, state regulatory agencies, Regional Transmission Organizations and Independent System Operators) on matters arising under federal and state statutes and implementing regulations, including the Federal Power Act, the Natural Gas Act, the Natural Gas Policy Act, the Public Utility Regulatory Policies Act, the Public Utility Holding Company Act and the Energy Policy Act of 2005.

Mr. Holmes focuses his practice in the area of energy and infrastructure projects and transactions with an emphasis on wind energy, solar energy, hydroelectric power, geothermal, biomass, natural gas, carbon offsets, and energy storage. His experience extends into corporate transactions, water law, and real estate law. Mr. Holmes also advises clients in negotiating major power purchase agreements, acquisition and sale of energy projects, EPC agreements, O&M agreements, fuel supply, and energy project development agreements.

Solar and wind power are now significant players in the electricity industry, but these projects are not without challenges on the electric grid. Energy storage is a solution to address these issues.
Due to an increased focus on energy storage systems, some states have adopted mandates and incentives for rapid deployment. Energy storage impacts multiple markets, each with different characteristics, different levels of regulatory uncertainty, and different cost-benefit analyses.
