Treating professionals, hospital staff, and corporate representatives are among the most significant witnesses in a medical malpractice case. During cross-examination, counsel will be able to scrutinize policies and practices to establish the standard of care on both a patient and enterprise level.

Good cross-examination begins with the depositions. Rule 30(b)(6) depositions are now routine in medical malpractice actions. Defendants include complex organizations, making it difficult to ascertain who is ultimately responsible for the decision at issue. Often there is a disconnect between policy and practice.
