This CLE webinar will provide attorneys, developers, producers, and investors guidance on recent developments and initiatives under the U.S. National Clean Hydrogen Strategy and potential challenges. The panel will discuss strategies and implementation under this new clean hydrogen strategy, regional clean hydrogen hubs, new Section 45V and other tax credits, U.S. Department of Energy (DOE) funding support for clean and renewable energy projects, current challenges for clean hydrogen projects, and key considerations for clean hydrogen project development.
Faculty

Mr. Howland is head of the firm’s Environmental Group; co-leads its hydrogen practice; and has an active renewable energy-focused practice. During his 28 year tenure at EPA he worked at the intersection of land cleanup and energy development, and spent his last four months at the Agency in 2018 in the Agency’s Office of Enforcement and Compliance Assistance, working on Superfund Task Force implementation. Mr. Howland’s work focuses on providing practical advice in the acquisition and sale of facilities and the redevelopment of brownfield sites; regulatory issues associated with renewable energy projects; counselling, enforcement, and litigation matters involving facility cleanups under federal and state laws; risk management plan preparation and emergency release/spill reporting; crafting real estate and other commercial transactions to address environmental concerns; and helping businesses identify ways to advance their operations in accord with national and international sustainability initiatives. Mr. Howland is nationally known for his work helping to facilitate the development of renewable energy projects on environmentally impaired land.

Ms. Wu represents companies in the energy industry in a broad range of matters involving rates, market rules and regulation, and energy commodity trading before the Federal Energy Regulatory Commission (FERC) and Commodity Futures Trading Commission (CFTC). She advises clients seeking to reduce their carbon footprint through new infrastructure assets, clean energy technologies, and transacting carbon credits and carbon offsets. Ms. Wu is an active member of the firm’s Energy Commodity Trading and Compliance Working Group, Hydrogen Working Group, Electric Vehicles Working Group, and Renewables Working Group.
Description
On June 5, 2023, the DOE issued the U.S. National Clean Hydrogen Strategy and Roadmap (Hydrogen Roadmap), providing a comprehensive strategy to advance the production, processing, delivery, storage, and use of clean hydrogen. The Hydrogen Roadmap summarizes the various initiatives contained in both the 2021 Infrastructure Investment and Jobs Act and the 2022 Inflation Reduction Act, including funding and construction of regional clean hydrogen hubs, tax incentives, public-private planning, interagency coordination, and other key areas and opportunities available for low carbon hydrogen-based projects. Thus, attorneys need to recognize the many ways in which such projects are being advanced.
Hydrogen made from renewable or low carbon electricity is key to decarbonizing certain sectors such as steelmaking, fertilizer, and other heavy-duty transportation, among others. Hydrogen also presents opportunities to assist in further decarbonizing the power sector by providing direct generation, energy storage solutions for off-grid electricity, and grid balancing. Thus, counsel must be aware of the legal issues and current trends for hydrogen’s potential role in the electrical grid specifically.
Although the potential benefits of using clean hydrogen in energy and related industries are attractive, the lack (or at least uncertainty) of federal regulations and guidance in certain key areas raises risks for energy companies, utilities, investors, and other stakeholders. Attorneys practicing in the energy and other related sectors must be aware of potential regulatory issues and other legal matters for hydrogen and related product production, application, and usage.
