Introduction
This CLE webinar will discuss how to assist clients with developing construction project site inspection plans, including regulatory concerns and key components that should be included in the plan for compliance and risk mitigation. The panel will also examine contractual drafting considerations related to the inspection process and address dispute resolution strategies to consider should conflicts surrounding inspections arise.
Description
Diligent site inspections are an essential component of any construction project--whether for quality, worksite safety, or ensuring contractual compliance. Counsel should understand the key components of a site inspection plan so that they can assist their clients with its development--including regulatory considerations for compliance, outlining inspection procedures, documentation and personnel requirements, and progress tracking.
In addition to assisting clients with plan development, counsel should be mindful of contractual considerations related to site inspections that should be included in the project agreements. Additionally, counsel must be aware of potential disputes that may arise out of the inspection process and how to mitigate dispute risks during plan development.

Presented By
Mr. Cahalan has substantial experience representing owners, contractors, subcontractors, engineers, architects, suppliers, manufacturers and vendors in connection with construction, commercial and other business matters. His practice primarily consists of drafting and reviewing construction contracts, providing advice during construction and construction litigation, arbitration and mediation. Mr. Cahalan was the primary drafter of the Associated Owners and Developers’ AOD 2002 – Standard Form of Agreement Between Owner and Contractor Where the Price Is Fixed or Lump Sum, and the Associated Owners and Developers’ AOD 2003 – Standard Form of Agreement Between Owner and Contractor for Work on a Cost Plus Fee Basis With a Guaranteed Maximum Price. He has also given numerous seminars throughout the U.S. and Europe concerning construction contracts, implied contract obligations, claims, green building, construction insurance, and mechanics lien law. Since 2010, Mr. Cahalan has been an instructor at the Georgia Institute of Technology where he teaches Design and Construction Law.
With over three decades of construction, environmental, and real estate litigation experience, Mr. Johnson brings seasoned leadership to complex legal challenges. He has served as lead counsel in over 30 jury trials, bench trials, and high-stakes arbitrations, handling disputes across construction, environmental compliance, land use, landlord-tenant issues, oil and gas, real estate, and toxic torts. Mr. Johnson’s construction law practice encompasses representing owners, general contractors, subcontractors, and design professionals in private and public works disputes. His extensive experience includes resolving claims involving extra work, changed conditions, delays, loss of productivity, defective workmanship, product liability for construction materials, insurance coverage for construction defect claims and property damage claims, including fire damage claims, and California contractor licensing laws. Mr. Johnson has successfully navigated construction disputes in state and federal courts across multiple states and before the federal Civilian Board of Contract Appeals and California’s Public Works Contract Arbitration program. In the environmental realm, his work includes addressing petroleum products and hazardous substance contamination of soil and groundwater, toxic tort claims arising from exposure to substances including asbestos and benzene, performing due diligence on environmental conditions in corporate and real estate transactions, and insurance coverage for environmental contamination.
Mr. Sherman is an experienced construction attorney with significant construction transactional, consulting, and litigation experience. In this capacity, he assists construction project owners, developers, general contractors, construction management firms, subcontractors, and material suppliers with real-time project consulting, drafting and negotiating all manner of construction agreements and forms, and with prosecuting and defending construction disputes. Mr. Sherman is a frequent lecturer on insurance law matters.
