This CLE webinar will discuss significant data privacy and cybersecurity decisions rendered in 2025 and the first part of 2026 and the implications these decisions have for businesses trying to maintain compliance and mitigate risks under the current legal framework. The panel will examine common plaintiffs' claims and theories of harm, provide guidance on proactive steps companies should take to prepare for and defend against potential lawsuits, and look at key litigation trends and developments from the first part of 2026 and beyond.

With the rise in the number of data and security breaches, companies are increasingly at risk for a potential lawsuit after a breach occurs. Litigation based on consumer protection laws, breach of contract, negligence, invasion of privacy, and unjust enrichment are just some of the claims being brought by plaintiffs, sometimes within just days or weeks after a security incident has occurred.
The number of states that have enacted or introduced legislation to protect consumers' personal data continues to grow. These new state laws present compliance challenges as well as increased litigation risks because many provide a statutory basis for new types of claims against companies that fail to maintain compliance with the new requirements.

Presented By
Ms. Baxter-Kauf’s practice is concentrated in the firm’s data breach, antitrust law, business litigation, and securities litigation practice groups. She represents individuals, consumers, financial institutions and small businesses in litigation to protect their rights and, most often, the rights of the class members they seek to represent. Ms. Baxter-Kauf is a frequent author and presenter on data privacy and antitrust among other issues.
Mr. Suh has a long track record of successfully representing clients through complex legal issues inherent to unsettled areas of law and emerging technologies, including cybersecurity, data privacy, artificial intelligence, and intellectual property. Whether in the courtroom as lead counsel on a tech E&O case or guiding clients in establishing AI governance frameworks, his unique blend of business, engineering, and legal experience allows him to effectively communicate and bring together stakeholders from multiple disciplines. An experienced litigator with trial experience, Mr. Suh works closely with clients to drive successful, business focused results for his clients. His litigation experience includes privacy and data breach class actions (BIPA, CIPA/wiretapping, pixel, and FCRA/FACTA), tech E&O disputes (software and hardware implementation, tech design, and Artificial Intelligence), and intellectual property cases (copyrights, trademarks, and patents). Mr. Suh also has extensive experience leading incident response investigation and regulatory enforcement matters, including for highly regulated clients in the financial services and healthcare industries. In addition to his legal practice, Mr. Suh is an Adjunct Professor at the University of Illinois Chicago School of Law and University of Illinois Urbana-Champaign where he teaches Artificial Intelligence: Law and Policy. He is an affiliated faculty member at the Institute for Government and Public Affairs.
