This CLE webinar will analyze the unique aspects of proving or defending claims alleging emergency room malpractice.
Description
Claims that ER care fell below the applicable standard often involve allegations of delayed or poor communication and failure to follow emergency room protocols, understaffing, lack of training, unreliable equipment, and involvement of non-MDs, specialists, or consultants. Emergency care is complex for many reasons, and these types of cases require counsel to carefully analyze what decisions were made, when and by whom they were made, and then how those decisions were communicated.
A complete understanding is necessary of how emergency room medical records (ERMR) differ from medical records made in the ordinary course of treatment and how to best use that record to the client's advantage. Counsel should also recognize potential liability from ERMR design flaws, system downtimes, cyber intrusions, or unexpected ERMR crashes.

Presented By
Ms. Azzarito has been litigating since 1994, representing clients in Massachusetts state and federal courts and, more recently, in the federal court in Vermont. She focuses, in her practice, on the defense of medical professionals, but she also has a wealth of varied experience in other areas of the law, including criminal defense, white collar defense, administrative law, and general liability. In addition, Ms. Azzarito has represented numerous parents under the auspices of the Hague Convention on the Civil Aspects of International Child Abduction.
Ms. Jani is an attorney with over 15 years of experience in the civil litigation of medical malpractice, pharmacy errors, premises liability, personal injury and general liability matters. She is admitted to practice before all state courts in Louisiana and the United States District Courts for the Eastern, Middle, and Western Districts of Louisiana. She is a member of the Louisiana State Bar Association.
Dr. Stein, MD is board certified in both Emergency Medicine and Internal Medicine and subspecialty certified in Neurocritical Care. After Medical School at Vanderbilt University, Dr. Stein completed Residency at the University of Kentucky Medical Center and at Washington University Jewish Hospital. He has practiced Emergency Medicine for 29 years and Critical Care / Intensive Care Medicine for 27 years. Dr. Stein is an expert witness for both plaintiff and defense in cases involving emergency medicine, critical care and internal medicine, including damages & causation in personal injury and wrongful death cases. His professional association memberships include the American Association of Physician Specialties, the Society of Critical Care Medicine, and the American College of Chest Physicians.
