Introduction
This CLE course will analyze the impact of reclassifying marijuana as a Class III substance under the Controlled Substances Act (CSA) on the availability and scope of insurance coverage for cannabis-related businesses. The speakers will address how the cannabis insurance market has evolved and offer practical guidance on obtaining insurance and addressing claims-related issues.

Cannabis businesses need the same type of comprehensive, affordable coverage as other businesses but the gap between federal and state regulation has left these businesses with fewer and often very restrictive options for liability, business interruption, D&O, and other insurance products. Recent developments at the federal level signal that more options may be forthcoming.
Executive Order 14370 was signed on Dec. 18, 2025, instructing Congress to expedite the reclassification of cannabis from a Class I to a Class III substance under the CSA. This makes marijuana a prescription drug, but does not make it legal. When rescheduling occurs, cannabis businesses can reap tax benefits that should increase profits, cash flow, and company valuation, and increase access to capital and banking services. These changes are expected to open up newer and more traditional insurance products to cannabis and cannabis-related businesses.
