About the Course
Introduction
This CLE webinar will discuss the civil liability of non-perpetrator individuals and entities under the Trafficking Victims Protection Reauthorization Act (TVPRA), especially the transition to enterprise liability. The panel will review indicators of forced labor and trafficking, discuss how these claims are investigated and brought to trial, identify fact patterns that lead to or negate liability, and offer guidance and best practices for holding defendants accountable and for setting up proactive policies and procedures that prevent and disrupt such activities.
Description
Non-perpetrator third-party individuals and entities can be liable to victims of forced labor, human trafficking, or other specified and related acts under the TVPRA if they (1) knowingly benefited from (2) participation in a venture (3) that they knew or should have known engaged in forced labor or human trafficking. After a $40 million verdict in 2025, enforcement activity has accelerated, is increasingly coordinated, and is laser-focused on financial recovery. Risks have skyrocketed for companies whose infrastructures or services have been used by traffickers.
TVPRA risk is not confined to the hospitality industry. Anyone can be liable: landlords, transportation companies, digital platforms, staffing agencies, technology companies, sports and entertainment businesses, and the private equity owners of the foregoing. Companies have been sued based on the foreign actions of international supply chain vendors.
These lawsuits put individual and company integrity to the test. Discovery is a deep dive into a defendant enterprise's entire operation, policies, compliance programs, internal communications, historical risk assessments, and what employees or agents saw and reported. C-suite lip service to policies that existed only on paper is not a credible defense for either the company or its leaders.
Listen as this experienced panel offers guidance on bringing and defending TVPRA lawsuits, including best practices for preventing them in the first place.
