The IRS has ramped up enforcement efforts on ensuring that hospitals claiming tax-exempt status are qualified. The Service recently published its letter revoking a hospital’s tax-exempt status for failing to comply with IRC §501(r) requirements. The IRS 2017 work plan includes more focus on §501(r) compliance.
The IRS is reviewing all tax-exempt hospital §501(r) compliance and determining which hospitals call for further examination. Consequently, all §501(c)(3) hospitals should review and ensure their compliance with §501(r) requirements.
Failure to comply could result in a hospital losing its §501(c)(3) exemption as well as its ability to use certain employee benefit plans. Further, the hospital may be subject to other taxes and precluded from receiving tax-deductible contributions or tax-exempt bonds.
