Introduction

This CLE course will guide energy counsel on the legal issues involved in the implementation of energy storage projects. The panel will discuss the markets, regulatory landscape, and legal challenges for energy storage, including obstacles that may arise when co-locating battery projects with wind and solar, and provide tips on how to draft and negotiate contracts for the implementation of such projects.

Description

Solar and wind power are now significant players in the electricity industry, but these projects are not without challenges on the electric grid. Energy storage is a solution to address these issues, increasingly important to project development and grid operations.

With increased focus on energy storage systems, some states have adopted mandates and incentives for rapid deployment. Energy storage impacts multiple markets, each with different characteristics, different regulatory uncertainty, different cost-benefit analyses, and evolving tax incentives. More than ever, projects require close attention to evolving federal, state, and local requirements related to interconnection, permitting, and project safety.

Counsel must understand the different ways that energy storage works, how storage is regulated and deployed, and the legal risks and challenges for projects. What issues should attorneys be watching out for in developing these projects and negotiating contracts for their implementation? What makes battery projects different from wind and solar projects, including newer co-located configurations?

Mr. Hollingsworth's practice focuses on the representation of owners and developers in their construction projects, including renewable facilities, distributed energy projects, liquefied natural gas (LNG) facilities, power plants and petrochemical facilities. He has experience with drafting engineering, procurement and construction (EPC), construction, construction management, engineering, operating and maintenance, long-term service agreements and procurement agreements for projects throughout the world. Prior to becoming an attorney, Mr. Hollingsworth was an engineer at a global energy company, where he focused on the development of large scale capital projects. Nearly three of his years at the company were spent working in Papua New Guinea developing a gas processing facility. He has extensive knowledge on project execution, project controls, HSSE and construction management.
