Before looking at the available answers, read the call of the question so you can determine the subject being tested and the issue you are tasked to answer—without being distracted by the answer choices.
2. Identify the Legal Issue
If the call of the question isn’t specific enough, read the sentence above the call for more context and, if necessary, quickly scan the answer choices for subject-specific terms that can help identify the area of law being tested.
The sooner you identify the issue, the easier it becomes to focus on the legally relevant facts.
3. Formulate Your Own Answer
While still hiding the answer choices, use the facts presented—along with the applicable legal rule—to formulate your own answer.
This step is critical. When you generate an answer independently, you're engaging in the same legal analysis required on exam day rather than simply reacting to the options provided.
4. Compare Your Answer to the Choices
Only after you've reached your own conclusion should you review the answer choices. Select the option that most closely matches the result you reached through your analysis. Often, multiple answers will appear reasonable. The correct answer is the one that best applies the governing rule to the facts provided.

Should I Skip Hard MBE Questions + Come Back Later?
While it may sound like a good strategy in theory to save time by skipping difficult questions and returning to them at the end of the exam, we generally recommend a different approach.
Toward the end of a three-hour session, mental fatigue becomes a real factor. Your concentration naturally wanes, making difficult questions even harder to solve.
Instead:
- Apply your systematic approach immediately.
- Eliminate clearly incorrect answers.
- Make your best selection.
- Mark the question in your test booklet.
- Move on.
If time remains at the end of the session, you can return to marked questions and reevaluate them with a fresh perspective. Remember, unanswered questions receive no credit so a thoughtful best guess gives you a chance to earn the point.
