This CLE webinar will provide attorneys an in-depth analysis of potential ethical risks and liability stemming from AI tool errors when used in the practice of law. The panel will discuss applicable ethical rules, the use of Agent AI and other tools in a law practice, pitfalls to avoid, and other key issues.
Faculty

Ms. Wynn focuses her practice on legal ethics and professional responsibility, civil and commercial litigation, and complex business and contract disputes. Regarding Legal Ethics and Malpractice, she represents lawyers and firms in disciplinary investigations, prosecutions, and malpractice matters. Ms. Wynn frequently advises lawyers and law firms in understanding and complying with their legal ethics obligations. She is a Lecturing Fellow at Duke University Law School, where she teaches “Ethics and the Law of Lawyering,” and is a frequent speaker and writer on evolving issues in legal ethics. For Civil Litigation, White-Collar Criminal Defense, and Investigations Ms. Wynn represents individuals and companies in all stages of civil and criminal litigation. Grace also conducts internal investigations in response to government enforcement actions.
Description
The ABA Model Rules of Professional Conduct Rule 1.1 requires attorneys to "provide competent representation to a client." The use of Agent AI and other artificial intelligence tools are increasing in use across the legal practice industry. Attorneys have an ethical duty to be competent when using Agent AI or other technology in their practice.
Agent AI systems are artificial intelligence technologies that differ from reactive AI in that they are able to initiate or adapt actions independently, including the ability to execute multi-step tasks based on user input. The use of Agent AI is riddled with potential ethics liability and risks and attorneys must be aware and take action to mitigate the risks associated with these tools.
While Agent AI and other technology are opening new doors with time-saving tools, the technology has limitations that could be problematic if left unchecked. The limitations typically center around the accuracy of its output and the data used to train its systems. Proper oversight is critical when using AI tools in the practice of law.
