Introduction

This CLE course will prepare in-house counsel to address the legal, business, and ethical challenges inherent in their role as crisis manager for their corporation. The panel will discuss best practices for risk assessment and planning, liability mitigation, preserving business continuity, and resolving lawsuits and negative media fallout.

Description

Data breaches, natural disasters, social media attacks, food-borne illnesses, and other unforeseen events continue to propel corporations into the spotlight, forcing their in-house counsel to quickly and meaningfully respond to the crises. Without a plan and proper implementation, business disruptions, negative publicity, lawsuits, and government investigations can seriously threaten a company's survival and prosperity.

Before a crisis strikes, counsel should design a crisis management response plan and identify and train key crisis response staff. During the crisis, counsel should identify potential areas of liability and damages and take steps to mitigate risk. In the aftermath of the crisis, counsel must assess the likelihood of lawsuits and develop an effective trial or settlement strategy.

While managing the legal risks inherent in crisis planning and response, counsel must also ensure that the business' interests are protected when communicating with the media and other third parties about the incident.
